On March 5, 2018, the Texas Commission on Environmental Quality (TCEQ) released the “New General TPDES Permit for Construction Activities.” This general permit authorizes the discharge of stormwater runoff associated with small and large construction sites and certain non-stormwater discharges into surface water in the state.
The City’s Stormwater Services Division is responsible for enforcing federal, state and local Stormwater Construction permit requirements throughout the City of Abilene. This includes ensuring that sites are properly permitted and, if required, Stormwater Pollution Prevention Plans are implemented. They also ensure that erosion and sediment controls are adequately maintained on these sites.
A SWPPP is a document which identifies sources and activities at a particular facility or construction site that may contribute pollutants to stormwater runoff by discharging into the Municipal Separate Storm Sewer System or MS4. The SWPPP outlines a plan developed by the operator to minimize pollutants from coming off the site and into the Municipal Separate Storm Sewer System by using specific site control measures or Best Management Practices (BMPS).
A SWPPP must be prepared and implemented prior to the beginning of construction activities in accordance with the requirements of the Construction General Permit or any individual NPDES or TPDES permit issued for stormwater discharges from the construction site.
The operator of a construction site required to have a NPDES/TPDES permit to discharge stormwater associated with construction activity shall submit a copy of the notice of intent (NOI) to the City of Abilene Stormwater Services Division at the same time the operator submits the original notice of intent to the EPA or the TCEQ, as applicable.
The operator of a construction site, which does not require an NOI, is required to submit, per TCEQ’s TPDES general permit for construction sites, a construction site notice to the City of Abilene Stormwater Services Division.
